Pensions for repatriated foreign workers

In the event of permanent repatriation, the foreign worker with a non-seasonal employment contract retains the social security rights acquired in Italy and may benefit from such rights even if there is no reciprocity agreement with the country of origin.

Pensions are intended for foreign workers who paid their contributions in Italy and who are repatriated (returned forever) to their country of origin.

In the case of an old-age pension calculated on the basis of the contribution system, foreign workers hired after 01 January 1996 may, in the event of repatriation, receive an old-age pension at the age of 66, both for men and for women, in addition to life expectancy adjustments, and even if the requirements have not accrued (therefore, even if they have fewer than 20 years of contributions).

Therefore, in the event of an old-age pension calculated by payment or mixed system, foreign workers hired prior to 1996 may, in the event of repatriation, receive an old-age pension at the age of 66, both for men and for women, adjusted by changes to life expectancy, if they possess 20 years of contributions.

In the event of death after the age of 66, the survivor's pension is payable if the conditions for all dependent workers are met.

The claim for both the old-age pension and the survivor's pension is submitted via form AP 50, to be submitted to the Direzione provinciale INPS di Perugia (Provincial INPS Management of Perugia), located in via Canali, 5 - 06122 Perugia. The form can be submitted online or downloaded in PDF format and submitted directly by the interested party or through a patronage institute.

A worker belonging to a non-EU country that is not covered by a convention – who has definitively returned to their country of origin and is in possession of the login details– may apply online. The worker will subsequently be required to send the documentation to the INPS via post and will be able obtain authentication of such documentation at the Italian consulate of the place of residence. When completing the digital INPS form, the foreign worker must indicate the information relating to their current residency.

However, a definitively repatriated foreign worker who does not possess a PIN will be able to submit their claim through the Italian consulate of the place of residence.

Both procedures described for claiming benefits concern foreign citizens who are nationals of countries with which an international convention on social security, signed by Italy, does not apply.
