Constant attendance allowance for immobile patients or those in need of continuous assistance (civilian invalids)

Publication: 15/02/2022

The Constant attendance allowance is an economic benefit, paid on demand, in favour of civilians who are totally disabled due to physical or mental disabilities for whom the impossibility of walking without the help of a carer or the inability of performing everyday tasks has been ascertained.

It is due to citizens for whom total incapacity (100%) has been ascertained and who permanently reside in Italy, regardless of personal annual income and age.

Start date and duration

To be entitled to the financial allowance, the citizen must make a request for recognition of their health conditions, by submitting a claim via the "Civilian invalidity - Submit claim for the recognition of health requirements” service.

Once the health and administrative requirements envisaged have been confirmed, the financial allowance is paid for 12 months starting from the first day of the month following the one in which the claim was made or, in exceptional cases, from the date indicated by the health authorities in the report of acknowledgement of the civilian invalidity sent by the Institute. Payment of the compensation is suspended in the event of totally recovering to be borne by the State for a period exceeding 29 days.

What am I entitled to?

For 2019, the compensation is € 517.84.

Incompatibility

The constant attendance allowance is incompatible with similar benefits paid for reasons of service, work or war, except the option right for the most favourable benefit.

The constant attendance allowance is compatible with the performance of work, whether dependent or self-employed, and when holding a special license.

The constant attendance allowance is also compatible and may be combined with the incapacity pension, with pensions and constant attendance allowances for completely or partially blind people (multi-disabled persons).

Requirements

Compensation is due to the following:

  • Those acknowledged as being totally incapacitated (100%) due to physical or mental disabilities;
  • those unable to walk on their own without the permanent help of an accompanying person or to perform everyday tasks without continuous assistance;
  • Italian citizens;
  • foreign EU citizens listed at the registry office of their municipality of residence;
  • non-EU foreign citizens who hold a residence permit that is valid for one year (article 41, Consolidated Immigration Act);
  • Have a permanent and regular residence within the national territory.

Minors holding a child attendance allowance are automatically acknowledged the incapacity pension reserved for adults who are totally incapacitated when they reach legal age. For minors who have just turned 18 years old are still obligation to submit form AP70.

When can I claim?

To receive the allowance, the disability must be confirmed in advance by means of a medical and legal assessment and the issuance of a health report.

It is therefore necessary to obtain an introductory medical certificate from a GP with the attached code which must be entered in the health verification request and sent to the INPS using the “Civilian invalidity - Procedures for confirming health requirements (InvCiv2010)” service”.

The confirmation process is complete after the INPS has sent out the civilian invalidity report. This is sent either by registered mail with a return receipt or to a certified email (PEC) address if provided by the applicant and can be accessed through the On-line mailbox service.

Once the report has been received with recognition of the disability, the citizen must submit the AP70 form via the Civilian invalidity - Send socio-economic and income data for the granting of financial allowances service.

For submitting either the health verification request or the confirmation of socio-economic requirements (AP70 form), the citizen can independently use the on-line services available on the INPS portal, accessing them using their tax code and PIN or SPID (Public system for digital identification). Alternatively, claims can be made using electronic services offered by institutions for advice and social assistance.

For minors holding a child attendance allowance upon reaching legal age, the benefit reserved for adults is due without needing to submit an administrative claim and without the need for further health verifications.

How can I claim?

Once the introductory medical certificate and the read code have been obtained, the claim should be made to the INPS on-line using the dedicated service.

Alternatively, claims can be made via institutions for advice and social assistance or via Italian organisations for the disabled (ANMIC, ENS, UIC, ANFASS) using their on-line services.

With the exception of claims made by cancer patients, it is not possible to submit a new claim for the same allowance until the current one has been completed, or, in the event of a judicial appeal, until the final judgement has been reached.
