What the worker must
The worker must immediately notify the employer, unless prevented by circumstances beyond his/her control, before the time when he/she is next supposed to be at work; after that, a doctor’s sick-note, issued before the end of the day following the start of the illness, must be sent to the employer within two days of being issued.
What the employer must do
No INPS benefit is paid when a domestic worker is absent from work due to sickness.
When a domestic worker falls sick (whether living in or not), the job must be kept open for him/her for a period which depends on the length of service in the household:
- 10 days if the length of service is less then six months;
- 45 days between six months and two years;
- 180 days if the length of service exceeds two years.
In addition to holding the job open, the employer must continue to pay wages at half the contractual rate for the first three days and then at the full rate for each following day, up to a maximum of:
- 8 days if the length of service is less than six months;
- 10 days between six months and two years;
- 15 days if the length of service exceeds two years.
The worker is not entitled to payment in lieu of board and lodging during any stay in hospital or while convalescing in the employer’s home.
